Construction Accident

  • Plaintiff was working as a construction worker on a project rebuilding an overpass on the Southern State Parkway. A co-worker attempted to lower a concrete form to Plaintiff when the railing above him collapsed. The concrete form struck the Plaintiff and pinned him on the ground. As a result he sustained bulging discs in his neck and lower back. A Court of Claims Judge awarded $865,000.00.
  • At a construction site for an auto dealership, a worker taping sheetrock sustained a scaffold injury. He fell when the unsecured scaffold he was standing on suddenly shifted. The 48-year-old laborer suffered a shoulder injury and both of his knees were damaged. Award: $775,000.
  • A 41-year-old elevator mechanic was injured on a NYCHA project in Brooklyn. There was no protective netting in place in the elevator shaft to protect workers below from falling objects. He was struck in the eye by the butt of a falling screw driver. He suffers a partial loss of vision and color blindness. Award: $660,000.
  • Plaintiff was a 53 year old construction mechanic who was installing lights when he was caused to slip and fall from an aluminum ladder due to the ladders lack of rubber footings for traction. Case settled after a ruling of the Appellate Division 2nd Department. Award: $410,000.00

Motor Vehicle

  • While at a stoplight in Queens, a 25-year-old construction worker was rear-ended while riding in his sister's car. His knee injuries required two surgeries. The verdict significantly exceeded the policy limits of $250,000. Award: $915,000.
  • A 12-year old girl walking home from school was struck by a school bus that did not properly yield. She suffered a compound fracture to her leg, a broken jaw, and a shoulder injury. After an extended hospital stay, she also had to have her mouth wired shut for over a month. The jury found the school board 80% liable for her injuries. A settlement was reached before a jury could deliberate. Award: $750,000.
  • A 45 year old man was driving injured when he was involved in a motor vehicle accident. He suffered a back surgery requiring surgery to fuse the vertebrae together, 2 posterior herniations of the discs located in his cervical spine and other various back injuries.   • A 67 year old woman was injured while she was exiting a vehicle pulled off to the side of the road, when the vehicle was rear ended. She suffered injuries to injuries to her right knee requiring surgery. Case was settled after a liability verdict. Award: $150,000.00
  • While lawfully crossing the street at a crosswalk a 33 year old pedestrian was injured when she was struck by a vehicle. She suffered a fracture to her left leg. Case settled after Jury Selection. Award: $80,000.00

PREMISES LIABILITY

  • Lax security at a shopping mall put a kiosk vendor at risk. Our client, a 38-year-old vendor, was setting up his stand early one morning. Security personnel employed by the mall failed to lock the door before the mall opened. A burglar entered the mall and assaulted him, stabbing and robbing him. Award: $4 million.
  • A midtown building porter who dislodged a jam in a trash compactor was unable to turnoff the machine. The safety switch had been removed and the machine's manual shutoff button was broken. The disposal door fell down and struck our client in the head. The hand he used to break his fall was pulled into the machine and was cut off. He later had to have two amputations. Award: $2.4 million.
  • A 52 year old man was injured when he was caused to slip and fall down steps due to oil cans being placed near the top of the deteriorated stairs. He suffered a broken right foot and an ankle injury requiring surgery. Case settled while appeals were pending after a verdict. Award: $1,950,000.00
  • A bouncer at a popular midtown Manhattan theme restaurant greeted a 16-year-old teenager, escorted her to the third floor to view a music display, and sexually assaulted her. Award: $865,000.
  • A 29 year old woman was injured as she was descending down a flight of stairs and was caused to trip and fall when her foot became tangled in the carpet which was installed improperly. She suffered injuries to her back. The verdict was for $920,000.00 but was reduced by the Appellate Division. Award: $725,000.00 plus interest.
  • A 56 year old man who was walking home from work when he was caused to slip and fall over a raised portion of sidewalk which was covered with ice. As a result of the fall Plaintiff sustained a severe fracture of the Right Fibula and Tibia requiring surgery to install pins and plates. Award: $375,000.00
  • Plaintiff was a 21 year old bar tender when her foot struck a jug on the floor while she was working and she was caused to sustain burns to her left ankle due to the cleaning chemicals in the jug used as part of a washing system. Case was settled during trial. Award: $350,000.00
  • A handicapped woman suffering from severe asthma parked her vehicle in a handicapped spot at a shopping mall, tripped where the ramp met the curb, and suffered a fractured elbow requiring two surgeries. This case was settled prior to jury deliberations. Award: $250,000.

WORKPLACE INJURIES

  • While using a 3 to 4 aluminum step ladder to paint the inside of a window frame in a classroom, the 48 year old Plaintiff was caused to fall from the ladder due plywood on the floor because the floor was being renovated. Case settled after jury deliberation. The verdict was 4.2 Million dollars but it was settled pursuant to high/low. Award: $1,800,000.00
  • While working in an apartment doing renovations a 50 year old painter was injured when the ladder he was using fell out from under him. He suffered injuries to left shoulder requiring surgery. Case was settled just prior to summation after eleven (11) days of testimony. Award: $1,750,000.00
  • A loading ramp began to move unexpectedly causing our client, a factory worker standing on a ramp, to fall and slam into a wall. He later suffered the amputation of his right thumb. We filed suit against both the property owner and the manufacturer of the loading ramp. Award: $1.25 million.
  • A 49 year old painter who was working on a building in Manhattan when he was injured when the scaffolding he was standing on collapsed due to a broken wheel.   • An alarm and video installer, working at a new retail establishment in Nassau County, fell from his stepladder, landing first onto a collection of industrial coffee pots before hitting the ground.   • A 44 year old theatrical worker was injured while preparing a stage for a Victorias Secret Fashion show when he fell through a gap between the stage and the floor due to carpeting being installed over the gap. He suffered injuries to his left shoulder requiring surgery. Case was settled before trial. Award: $225,000.00
